Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned Patta No.1438 issued by the second respondent and quash the same as illegal as it relates to the inclusion of the names of the respondents No.4 to 8 in S.No.139/8 Kudicheri Village, Peraiyur Taluk, Madurai District is concerned and consequentially to make necessary mutation in revenue records within the time that may be stipulated by this Court.

ORDER

The present Writ Petition has been filed challenging the order passed by the second respondent herein, under which, the patta issued including the names of the respondents No.4 to 8.

2. The petitioner has not approached the revenue authorities. If he is aggrieved against such entries, the petitioner has to approach the revenue authorities, namely, the third respondent herein for rectification of the defects.

3. Therefore, this Writ Petition is disposed of with liberty to the writ petitioner to approach the third respondent herein by making appropriate application with relevant documents to substantiate his case. On such application is made by the petitioner, the third respondent shall conduct an enquiry on the same after affording an opportunity to the necessary parties and pass appropriate orders on merits and in accordance with law, within a period of three months from the date of submission of application by the writ petitioner. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
