PRAYER :- For Bail in Crime No.157 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.4 herein, who was arrested on 13.07.2023 for the alleged offence under Sections 147, 148, 294(b), 342, 307 and 506(ii) of IPC, in Crime No.157 of 2023, on the file of the respondent police, seeks bail. 1/4
2.The case of the prosecution is that on 24.05.2023, the petitioner's son along with other accused danced in front of the stage, causing disturbance to the public. Hence, the defacto complainant warned them. Due which on the same day at about 9.30 p.m., the petitioner along with other accused quarreled with the defacto complainant, abused him in filthy language, threatened him with dire consequences and attacked with aruval.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor submitted that on the eve of temple festival in the Village, trouble arisen between the defacto complainant party and the accused. It is alleged that they were standing in front of the stage when the event was going on. Two persons have been sustained injuries and after taking treatment discharged from the hospital. The petitioner was arrested and remanded into judicial custody on 13.07.2023. Ever since he is in custody. According to the learned Additional Public Prosecutor, the petitioner is having four previous cases. Among which one is for the offence under NDPS Act and another one is for 397 IPC. Apart from the he is a History sheeted person in H.S.No.364/2004. He would further submit that final report was also made ready in this case and it will be presented 2/4
before the concerned Court, within a short period. 5.Considering the period of incarceration and the fact that the final report has also been made ready and about to be filed before the concerned Court, this Court is inclined to grant bail to the petitioner with stringent conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Trichy and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
