Respondents/Respondents Prayer :- This Criminal original petition filed under section 482 of the Criminal Procedure code, to call for the records relating to the S.C.No.120 of 2016 on the file of the District and Sessions court, Sivagangai and quash the same.

ORDER:- This Petition coming on for orders on this day and upon perusing earlier order of this Court dated 09.03.2020, and direct the trial Court to expedite the trial and complete the same within four months from that day, and the requisition letter dated 09.05.2022 in D.No.4004 of 2022, submitted by the Vacation Sessions Judge, Sivagangai, this Court made the following order: Today, this case is listed under the caption for "Extension of Time for Lower Court".

2. It is evident from the records that this Court vide order dated 09.03.2020 has directed the trial Court to expedite the trial and complete the same within four months from that day.

3. Now, the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Sivagangai, has submitted a requisition on 06.05.2022 through the Vacation Sessions Judge, Sivagangai, stating that the direction of this Court was brought to the notice of the concerned officer by a memo on 06.05.2022 and that the case was posted to 10.05.2022 for framing of charges and seeks https://www.mhc.tn.gov.in/judis 1/2

three months time for dispose of the said case.

4. As already pointed out, this Court has specifically directed the trial Court to expedite the trial and complete the same within a period of four months from 09.03.2020, but for the past 2 years, the concerned Judge has not submitted any requisition, seeking further extension of time and the present requisition was sent on 06.05.2022. It is pertinent to note that charges are yet to be framed. Hence, the Registry is directed to call for a report from the Principal District Sessions Judge, Sivagangai, as to why the direction of this Court was not complied with by the concerned Judge along with their explanation

5. Considering the present requisition, this Court is inclined to extend the time sought for. Accordingly, three months time is granted and the trial Court is directed to complete the trial and dispose of the case in S.C.No.120 of 2016 within a period of three months from today.
