PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to release the document kept in pendency in Doc.No.P/Madhugapatti/16/2025, dated 29.05.2025 in light of the order passed in Cr.M.P.No.203/2025 in Cr.No.3 of 2023, dated 21.05.2025, on the file of the Special Court for TNPID Act. ORDER
This writ petition is filed for Writ of Mandamus, to direct the respondents 1 to 3 to release the document kept in pendency in Doc.No.P/Madhugapatti/16/2025, dated 29.05.2025 in light of the order passed in Cr.M.P.No.203/2025 in Cr.No.3 of 2023, dated 21.05.2025, on the file of the Special Court for TNPID Act.
2. The learned counsel appearing for the petitioner submitted that admittedly, the disputed property was attached by the TNPID Court. Hence, the petitioner approached the TNPID Court and filed a petition in Cr.M.P.No.203 of 2025 in Crime No.3 of 2023, to release a document, where the petition was allowed on 21.05.2025 and directed the respondent to release the document. In 2/5
spite of the same, the respondent failed to release the document.
3. The learned Additional Government Pleader appearing for the respondents 1 to 3, on written instructions, submitted that there is no appeal filed by the Revenue Officials. The said submission is recorded.
4. Based on the above submissions and observations the following directions are issued:
4.1. The second respondent is directed to consider the petitioner's claim in the light of the order passed in Cr.M.P.No. 203 of 2025 in Crime No.3 of 2023 dated 21.05.2025. 4.2. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. 4.3. Since no appeal has been filed by the Revenue Officials, the Sub Registrar cannot direct the petitioner to clarify whether the appeal has been preferred. If the sub registrar has any doubt, he may independently clarify the same with the ADGP.
4.4 The writ petition is allowed as stated supra. No costs. 28.07.2025 3/5
