Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to dispose of the appeal filed by the Petitioner dated 29.01.2025 against the order passed by the second respondent dated 16.12.2024 on merits and in accordance with law within a time frame as fixed by this Hon`ble Court.

ORDER
This writ petition has been filed seeking a direction to the first respondent to dispose of the appeal filed by the Petitioner dated 29.01.2025 against the order passed by the second respondent dated 16.12.2024 on merits and in accordance with law within a time frame as fixed by this Court.
2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner was promoted as Bill Clerk in the year 2016 and was subsequently transferred to the Virudhunagar Region in the year 2023.
The second respondent, by proceedings in Se.Mu.Order.No.E4/3853/2022 dated 16.12.2024, erroneously concluded that the alleged charges against the petitioner stood proved and, as a consequence, imposed the punishment of stoppage of increment for one year without cumulative effect and further directed that the amount of loss allegedly incurred by the respondent Corporation be recovered from the petitioner's salary in three instalments. dated 16.12.2024, the petitioner preferred an appeal on 29.01.2025 before the first respondent along with an interim application seeking stay of operation of the order passed by the second respondent. Thereafter, the petitioner received a communication dated 13.02.2025 from the first respondent, directing him to furnish the original order of the second respondent dated 16.12.2024, which was challenged in the appeal. Accordingly, the petitioner forwarded the original order of the second respondent dated 16.12.2024 along with the appeal to the first respondent on 28.02.2025 through Registered Post. However, even after receipt of the same, the appeal remains pending before the first respondent without any progress. Hence, the petitioner has been constrained to file the present Writ Petition.

Considering the limited request of the petitioner, there shall be a direction to the first respondent to dispose of the appeal filed by the petitioner dated 29.01.2025 on its own merits and pass appropriate orders in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits.

5. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
