ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 1/8
27.01.2025 for the offence punishable under Sections 397, 120(B), 400, 149 of IPC, in PRC.No.9 of 2021 on the file of the Judicial Magistrate-I, Karur, seeks bail,
2. The case of the prosecution is that on 02.04.2007, the petitioner along with other accused persons have robbed 24 sovereigns of gold jewels from the defacto complainant's house in knife point, subsequently locked the door with the defacto complainant and his mother and flew away from the scene of occurrence. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner was arrested and remanded to judicial custody on 14.04.2007 and subsequently, he was released on bail. Further, on completion of investigation, the respondent police has laid down charge sheet before the learned Judicial Magistrate No.1, Karur and the same was taken in PRC.No.26 of 2007. Further, the case was split up in PRC.No.3 of 2018 against the accused 2 to 5, again which the case against accused 3 to 5 was split up in to PRC.No.9 of 2021 before the Judicial Magistrate -I, Karur. In the meanwhile, the petitioner shifted his residence from Madurai to Chennai for his livelihood, after the split up proceedings the summon was not served into the petitioner current residential address, so far as not aware of this case. But subsequently, the petitioner arrested and remanded to judicial custody on 07.10.2023 to 27.07.2024 in connection with Crime No.408 of 2023 on the file of Pudukkottai Town Police Station, thereby 2/8
the petitioner not attending to trial proceedings, Hence, the learned Judicial Magistrate -I, Karur issued non-bailable warrant against the petitioner in PRC.No.9 of 2021 dated 08.03.2024 and the same was executed on 27.01.2025. He further submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks bail to the petitioner.

The learned Government Advocate (Criminal Side) submitted that there are twenty eight previous cases pending against the petitioner and the petitioner was failed to appear before the concerned Magistrate and hence NBW was issued against the petitioner. Considering the facts and circumstances of the case and also the fact that there are twenty eight previous cases pending against the petitioner and Nonbailable warrant was issued in the year 2024 and executed only on 27.01.2025 and if the petitioner enlarging on bail at this point of time, he may abscond, and the petitioner is a habitual offender and considering the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
