ORDER: This Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 07.07.2025 for the offences punishable under Sections 331(3) and 305(a) of BNS, in Crime No.50 of 2025 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 07.07.2025, the defacto complainant went to his relative's marriage, at that time, the accused person broke open the house and committed theft. They have taken more than 11 1⁄2 sovereign of jewels worth about Rs.1,64,000/-. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide any conditions that may be imposed by this Court. Hence, he seeks bail.
4. The learned Government Advocate (Criminal Side) submitted that on the date of the occurrence, while the defacto complainant was attending a relative's 2/4
marriage, the petitioner allegedly broke into the complainant's house and committed theft. He further submitted that the properties have been recovered. The petitioner is having 26 previous cases, out of which, 8 cases are pending. He also submitted that the investigation is pending and hence, he opposed to grant bail to the petitioner.
5.Considering the nature and gravity of the offence and also considering the fact that the investigating is pending and the petitioner is having 26 previous cases and taking note of the bad antecedents, this Court is not inclined to grant bail to the petitioner at this point of time. Accordingly, this Criminal Original Petition is dismissed.
