ORDER
The above application has been filed seeking orders to condone the delay of 449 days in fling the appeal, against the award made in M.C.O.P. No.2097 of 2017, dated 31.01.2024 on the file of the Motor Accident Claims Tribunal cum Special Sub Court, Madurai.
2. When the matter is taken up for hearing today, the learned counsel for the petitioner/appellant would submit that the matter was settled before the Tribunal and seeks permissions of this Court to withdraw this petition and he has also made an endorsement to that effect.
3. In view of the above, this Civil Miscellaneous Petition is dismissed as withdrawn. Consequently, the Civil Miscellaneous Appeal is rejected at the SR stage itself. No costs.
