Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to dispose of the appeal, dated 7.12.2024 filed by the Petitioner for including her name in the joint patta issued in Patta No.586 along with the other legal heirs in respect of the property situated in S.No.160/1B to an extent of 0.20.50 ares(50.5 cents) and S.No.166/2B to an extent of 0.92.0 ares(2 acres and 27cents).

The Petitioner herein seeks a direction to the first respondent to dispose of the appeal filed by the Petitioner on 07.12.2024 seeking inclusion of Petitioner's name in the joint patta issued in Joint Patta No.586 in respect of the property situated at Thulukkapatti Village, Virudhunagar Taluk and District. 2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, the subject property originally belong to her grand-father Kumarasamy Naicker. He had two sons by name, Veeranagappan and Subburaj. Now patta has been issued in the name of three sons of Subburaj and her brother ie., son of Veeranagappan. Therefore, the Petitioner submitted an application before the first respondent seeking inclusion of her name in the joint patta on 07.12.2024. The same has not been considered till date. Hence the Petitioner has come before his Court with the present Writ Petition for the relief stated supra. 4.Mr.M.Gangatharan, learned Government Advocate, who 2/5

takes notice for the respondents 1 and 2 would submit that the appeal filed by the Petitioner will be considered on its own merits within the time stipulated by this Court.

5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal filed by the Petitioner, dated 7.12.2024 and pass final orders on its own merits after issuing notice to the Petitioner, three sons of the Petitioner's brother Subburaj and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
