Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the third respondent to consider the petitioner's representation dated 16.02.2012. For Petitioner : Mr.M.Saravanakumar For Respondents : Mrs.S.Srimathy, Special Government Pleader.
ORDER
The relief sought for in the present Writ Petition is for a direction to direct the third respondent to consider the representation submitted by the writ petitioner on 16.02.2012.
2.The learned counsel appearing on behalf of the writ petitioner states that similarly placed person, who studied in an unrecognized institution, was provided with an order of appointment. Thus, the similar benefit is to be extended to the writ petitioner. The writ petitioner had also undergone the course in unrecognized institution.
3.Any educational qualification acquired through unrecognized institution is null and void and that cannot be a ground to seek appointment. The candidates, who studied in the recognized institution and obtained degree, alone are eligible to participate in the process of selection in Government Departments and therefore, the question of comparing another candidate would not arise at all.
4.In view of the fact that the writ petitioner has not established any legal right, even a direction to consider the representation cannot be granted. It is a precondition that for entertaining Writ proceedings, the writ petitioner should establish a legal right. In the present case on hand, the writ petitioner has not established even a semblance of legal right, so as to consider the relief sought for in the present Writ Petition. Accordingly, this Writ Petition stands dismissed. No costs.
