ORDER
The petitioner herein seeks a direction to the official respondents to conduct an enquiry based on the petitioner's representation dated 30.06.2025 cancelling the patta No.495 issued in the name of the private respondents 4 and 5 and restore the old Patta No.450 in the name of the petitioner.
2.Heard the arguments of Mr.J.Mohamed Ibrahim, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, the land in survey No.12/1B4, Sokkaneenthal Village, Kariyapatti Taluk, Virudhunagar District, belongs to him and old patta was issued in his name in Patta No.450. Subsequently, it came to the knowledge of the petitioner that a new patta was issued in favour of the private respondents in Patta No.495 for a larger extent of land in the said survey number including the petitioner's property. Therefore, the petitioner submitted a representation on 30.06.2025, seeking cancellation of the patta issued in favour of the private respondents, insofar as the property belongs to the petitioner is concerned and restoration of Old Patta No.450 in the name of the petitioner. The same has not been considered. Hence, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the representation of the petitioner will be considered in accordance with law.
5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the
representation of the petitioner dated 30.06.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and private respondents 4 and 5. Accordingly, this Writ Petition is disposed of. No costs.
