For Respondent : Mr.Rms.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.696/2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 457 and 392 IPC, in Crime No.696 of 2020, seeks anticipatory bail. 2.The case of the prosecution is that on 21.05.2020, the defacto complainant was sleeping inside the house, the accused persons entered into the house and snatched away her thalli chain. Hence, the complaint.
3.The earlier application filed by the petitioner seeking anticipatory bail was dismissed considering the gravity of offence. 4.The learned counsel for the petitioner submitted that based upon the confession statement of the co-accused only, this petitioner has been implicated and all the articles and jewels have been recovered from the co-accused. According to him, no custodial interrogation is required.

CRL OP(MD). No.16787 of 2022 5.Considering the manner in which the offence said to have been committed, this Court is not inclined to grant anticipatory bail to the petitioner. The petitioner shall either surrender before the police or before the concerned Court and seek regular bail. 6.With the above directions, this Criminal Original Petition is dismissed.
