Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the learned 1st Additional District and Sessions Judge (PCR Court), Thanjavur, to consider the bail application of the petitioner on the same day on his surrender in connection with the case in Crime No.253 of 2025 on the file of the 2nd respondent Police.

ORDER

The petitioner is the sole accused in Crime No.253 of 2025 on the file of the 2nd respondent Police. The said case was registered for the offence under Section 296(b), 115(2) and 351(3) of BNS and Sections 3(1)(r), 3(1) (s), 3(2)(va) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Therefore, the petitioner has filed this petition seeking a direction to the learned 1st Additional District and Sessions Judge (PCR Court), Thanjavur, to dispose of his bail application on the date of surrender.

2. The petitioner has already filed a petition before this Court in Crl.O.P.(MD)No.12003 of 2025 seeking the same relief. Since the petitioner has involved in four previous cases apart from this case and also considering the nature of offence, this Court, by its earlier order dated 16.07.2025, dismissed the said petition.

3. Since there is no change in circumstances after the dismissal of the earlier petition, this Court is not inclined to entertain this petition. 2/4
