RESPONDENT / REVISION PETITIONER Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to permit all the petitioners to withdraw a sum of Rs. 4,75,000/- (Four lakhs seventy five thousand rupees) which has been deposited before the learned Family court, Madurai to the credit of M.C No. 123 of 2017 by the respondent herein as the order passed by this Hon'ble Court in the above main Criminal Revision Petition in Crl.R.C(MD) No.670 of 2022.

Prayer in CRL RC(MD). 670/ 2022 :

To call for the records and set aside the order passed by the learned Family Court, Madurai in M.C. No. 123 of 2017, Dated. 13.04.2022 and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. CHANDRAKUMAR A, Advocate for the petitioner and of MRS.A.BANUMATHY, Advocate for the respondent, the court made the following order:- This petition has been filed seeking permission to withdraw the arrear amount that was deposited by the respondent before the trial Court as per the order of this Court dated 26.07.2022. 2.Since it is arrears of maintenance amount, the petitioner is entitled to withdraw the said amount. The respondent has also no objection for the same.

Crl.M.P.(MD).No.12112 of 2022 3.This Petition is allowed and the trial Court is directed to refund the said amount to the petitioner by following proper procedure.
