ORDER
Alleging that the third respondent herein after giving false complaint against the petitioner and same been registered in crime No.376 of 2016 on the file of the second respondent, the third respondent and his family members are continuously threatening the petitioner herein. Fearing threat to her life, the present petition is filed seeking police protection. 1/3
2.The petitioner herein contended that there is a property dispute between her husband and his paternal uncle by name Jagadeesan, who is the third respondent in this petition and defacto complainant in Crime No.376 of 2016. With an intention to grab the ancestral property, in which petitioner's husband has a share, the said Jegadeesan is pressurizing the petitioner and her husband to hand over the property and abusing them with filthy language and assaulted them. When this was reported to the second respondent, same was not taken for investigation whereas a false complaint given by the third respondent, has been taken up for investigation and crime No.376 of 2016 has been assigned. 3.Further, it is alleged in the petition that on 13.07.2016, at about 06.30 p.m., the respondents 4 and 5, on the instigation of the third respondent, trespassed into the house of the petitioner when she was alone with her children and threatened her.
4.From the contention of the petitioner, it appears that there is a property dispute between the petitioner's family and the third respondent's family. Already a complaint has been given to the second respondent by the third respondent and same is under investigation. If the petitioner participates in the investigation, true fact will come to light. This petition filed in the year 2016. Till date there is no adverse incident, which indicates for the fear of threat to life of the petitioner and her family members and it is only an illusion. Hence, this criminal original petition is dismissed. In any event, it is for the second respondent police to take appropriate action, if any adverse incident happened to the life of the petitioner or her family.
