ORDER

The petitioner has filed this Sub Application to re-open the Contempt Petition in Cont.P.(MD)No.274 of 2025, which was closed on 25.04.2025.

2. The petitioner's husband has lodged a complaint before the respondent Police and the same was registered in Crime No.108 of 2023. He has also filed a petition before this Court in Crl.O.P.(MD)No.5424 of 2024 that the case which was registered in Crime No.108 of 2023 has not been investigated by the respondent Police. When this petition was taken up for hearing on 11.07.2024, a representation was made by the respondent Police that investigation is almost completed and final report would be filed within a period of one month. Therefore, this Court, by order dated 11.07.2024, closed the criminal original petition with a direction to the respondent Police to file final report within a period of four weeks and also ensure that the final report is taken on file within a reasonable time.

3. Subsequently, the petitioner's husband died. Since the order of this Court passed in Crl.O.P.(MD)No.5424 of 2024 dated 11.07.2024 has not been complied with, the petitioner filed a contempt petition before this Court in Cont. P.(MD)No.274 of 2025.

4. When the contempt petition was taken up for hearing on 25.04.2025, the learned Government Advocate (Crl. Side) submitted that the final report was filed before the trial Court, however, it was not accepted by the trial Court that the accused has not been secured. It was further represented that they are producing the final report along with the accused on 25.04.2025. Therefore, recording the submission of the learned Government Advocate (Crl. Side), the contempt petition was closed. Now, the petitioner has filed this Sub Application that the final report has not been filed sofar.

5. Today, the learned Government Advocate (Crl. Side) submits that they have deleted two accused and filed the final report on 27.04.2025. However, it has been taken on file only on 16.09.2025. According to him, since the final report has been filed deleting two 3/5

accused, a notice was sent to the defacto complainant and thereafter, the final report was taken on file by the learned Judicial Magistrate.

6. Recording the submission of the learned Government Advocate (Crl. Side), this Sub Application is closed.
