The petitioners are figuring as accused Nos.4 and 5 in C.C.No.12 of 2014 on the file of the Judicial Magistrate No.2, Dindigul, for the offences under Sections 471, 294(b), 506(i) of I.P.C. r/w. 120(b) of I.P.C.
2. The defacto complainant is the second respondent, namely, Abirami. Abirami's father Perumal had two wives. Accused Nos.1 to 3 are the sons born through the first wife and two others were born through the second wife. It appears that suppressing the same, accused Nos.1 to 3 executed the power of attorney in respect of the properties of Perumal vide document dated 21.01.2011. Later when the same became known, the power of attorney was cancelled on 31.10.2012. Abirami lodged a First Information Report on 05.03.2013.
3. It was investigated and it culminated in a final report. Cognizance of the offences was taken in C.C.No.12 of 2014 by the https://hcservices.ecourts.gov.in/hcservices/ 1/3

4. Accused Nos.1 to 3 are not before me. The power agents/accused Nos.4 and 5 are before me. It is not in dispute that the power of attorney was cancelled by them, when the case was registered.
5. Therefore, I am of the view that continuance of the impugned prosecution against the petitioners herein is patently an abuse of legal process. Therefore, the impugned proceedings stand quashed as far as the petitioners are concerned. The criminal original petition stands allowed, accordingly. Of course the impugned proceedings will go on against accused Nos.1 to 3. Consequently, connected miscellaneous petitions are closed.
