Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorari to call for the records relating to the impugned order passed by the first respondent by his proceedings in Na.Ka. No.100/2023/A4 dated 07.08.2024 and quash the same. For Petitioner :

ORDER

This writ petition is filed for the following relief: "... pleased to issue a Writ, order or direction, specifically in the nature of Writ of Certiorari, calling for the records relating to the impugned order passed by the first respondent by his proceedings in Na.Ka. No.100/2023/A4 dated 07.08.2024 and quash the same and pass such further or other suitable orders as this Honorable Court may deems fit and proper in the circumstances of the case and thus render justice."

2. The grievance of the petitioner is that without notice to her, the impugned order has been passed and therefore, the writ petition.

3. Mr.B.Saravanan, learned Additional Government Pleader would submit that in respect of the very same impugned order, one Girija Malliga, the mother of the petitioner herein has addressed the District

Collector challenging the said order and the same has been forwarded by the District Collector to the District Revenue Officer, Theni.

4. Therefore, since an appeal has now been filed challenging the impugned order, this Writ Petition is disposed of with the following directions:

i. The District Revenue Officer, Theni, shall positively issue notice to all the interested parties including the petitioner, give them the date of hearing and orders shall be passed only after giving them a personal hearing; and ii. The District Revenue Officer, Theni, shall pass a detailed speaking order within a period of eight weeks from the date of receipt of a copy of this order."

No costs. Consequently, connected miscellaneous petition is closed. 28.08.2024 NCC : Yes/No Index : Yes/No Internet : Yes abr
