The petitioner is facing trial in S.T.C.No.596 of 2015 on the file of the Judicial Magistrate No.II, Srivilliputhur, Virudhunagar District.
2. Heard the learned counsel on either side.
3. The petitioner's counsel would contend that in this case, the registration of the First Information Report as well as the investigation of the case was made by the very same person. The offence is also trivial and minor.
4. In this view of the matter, I am of the view that continuance of impugned prosecution is not warranted. Hence, the impugned proceedings stand quashed. The criminal original petition stands allowed. Consequently, connected miscellaneous petition is closed.
