Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the third respondent District Registrar in Na.Ka.No.1762/A3/2025 dated 05.06.2025 and Na.Ka.No. 3441/A3/2025 dated 18.06.2025 quash the same as illegal and further direct the third respondent, District Registrar forthwith to register the Form VII submitted by the petitioner's Society on 18.03.2025 for the triennium 2025-2028.

ORDER
This writ petition has been filed challenging the impugned notice dated 05.06.2025 and order dated 18.06.2025 passed by the third respodent.
2. It is submitted that after the issuance of the impugned notice dated 05.06.2025 by the third respondent, the petitioner submitted a reply to the same on 16.06.2025. However, on 18.06.2025, the third respondent returned the reply by citing Section 41(4) of the Tamil Nadu Societies Registration Act, 1975.

The petitioner claims that it has taken over the assets (School) of Chinnalampatti Devangar Educational Association and that the transfer of educational agency was also recognized all along since 2011 and acted upon till 2022. However, citing Section 41(4) of the Tamil Nadu Societies Registration Act, 1975, the respondents have refused to recognise Form VII filed by the petitioner's society pursuant to an election held on 09.03.2025, which was ratified in the meeting of the general body of the petitioner society on 12.03.2025.

4. The reply submitted by the petitioner on 16.06.2025 to the impugned communication of the third respondent dated 05.06.2025 deserves to be considered. Mere rejection of the same by communication dated 18.06.2025 by citing the impugned show cause notice is not sufficient.

Under these circumstances, there shall be a direction to the third respondent to pass appropriate orders pursuant to the show cause notice dated 05.06.2025 within a period of four weeks from the date of receipt of a copy of this order. It is needless to state before passing orders, the petitioner shall be heard.
