ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the second respondent to expedite the investigation in the case in Crime No.275 of 2023 dated 23.09.2023 and file a final report before the concerned Court, within the time stipulated by this Court.

2. The learned Government Advocate (Criminal Side) appearing for the respondents would submit that the second respondent, after completing the investigation, has prepared a final report dated 20.10.2023 as 'Mistake of Fact' and RCS notice was served on the petitioner/defacto complainant but report is yet to be filed before the concerned Court.

3. The learned counsel appearing for the petitioner would submit that no RCS notice was served on the petitioner.

4. Considering the above, the second respondent is directed to serve RCS notice on the petitioner/defacto complainant and file a final 2/4

report before the jurisdictional Court within a period of two weeks from the date of receipt of a copy of this order. The petitioner is at liberty to file a protest petition, if so advised.

5. With the above direction, this Criminal Original Petition stands disposed of.
