ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 303(2) of the Bharatiya Nyaya Sanhita 1/3

(BNS), 2023, in Crime No.378 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The prosecution of the prosecution is that on 09.11.2024, the petitioner had damaged the Hundi through an Axe Blade belonging to the defacto complainant's temple and stolen a sum of Rs.2,000/-. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that there is no previous case pending against the petitioner. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) submitted that the petitioner has damaged the Hundi belonging to the defacto complainant's temple and stolen a sum of Rs.2,000/- and the same was recorded in the CCTV camera fixed in the temple. He further submitted that the stolen property has not been recovered and the investigation is at an initial stage and if the petitioner is released on anticipatory bail, he may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the nature of 2/3

the offence committed by the petitioner and the stolen property has not been recovered and the entire incidents were recorded in CCTV footage fixed in the temple and the investigation is still pending and the custodial interrogation is very much required. Further, if the petitioner is released on anticipatory bail, he may tamper the witnesses and abscond. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
