PRAYER: Writ Petitions are filed under Article 226 of the Constitution of India, praying for issuance of a writ of Mandamus, to direct the first respondent to give license to the petitioner to hold a revolver for his self defence/safety of his life.

ORDER

This Writ Petition has been filed to direct the first respondent to give license to the petitioner to hold a revolver for his self defence/safety of his life.

2.Heard the learned counsel for the petitioner, the learned Additional Government Pleader for the first respondent and learned Government Advocate (Crl.side) for the second respondent. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3.The petitioner's contention is that he is doing real estate business. In connection with that business, there is a life threat to the petitioner. Hence, the petitioner gave a complaint to the second respondent. Even thereafter, there is as a continuous life threat to the petitioner. Hence, the petitioner made a representation to the first respondent seeking license to hold a revolver for his self defence/safety. Since the same was not considered, the petitioner has filed this writ 2/4

petition.

4.The learned Additional Government Pleader for the first respondent, on instructions, submitted that the petitioner had not produced Form S-2, the standard format of undertaking for safe storage of firearms along with the required fee. If the petitioner submits the same, the application of the petitioner will be considered. 5.In view of the same, the petitioner is directed to file a fresh application along with the required documents. On such submission, the first respondent is directed to consider the same on its own merits and pass appropriate orders in accordance with law. 6.With the above direction, this writ petition is disposed of. No costs.
