ORDER

Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner and the respondent submit that this Civil Revision Petition is filed against the order of maintenance dated 30.06.2022 passed by the III Additional Subordinate Court, Madurai in I.A.No.201 of 2021 in H.M.O.P.No.168 of 2020 and pending the Civil Revision Petition, on the efforts taken by the learned counsel on either side, the matter has been amicably settled between the parties and they also agreed for divorce by mutual consent. Therefore, they request this Court to dispose of this Civil Revision Petition with liberty to the parties to file an application for divorce by mutual consent.

2. Since the matter has already been settled between the parties, the Civil Revision Petition is disposed of with liberty to the parties to file an application for divorce by mutual consent, if they are so advised. On filing such application, the trial Court shall consider the same, as per the decision rendered by the Hon'ble Apex Court in Amardeep 2/4

Singh Vs Harveen Kaur reported in 2017 (4) RCR (Civil) 608 and Amit Kumar Vs Suman Beniwal [C.A.No.7650 of 2021]. No costs. Consequently, connected miscellaneous petition is closed. 22.12.2022 ogy Index : Yes / No.
