Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no.149 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- 1/3

The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 8(c) r/w 20(b)(ii)(A) of NDPS Act, in Crime No. 149 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 08.07.2023 at 12.40 hours, at Rojma Nagar the 1st accused was found in possession of 50 grams of ganja. Based on the confession of A1 & A3 him other accused persons were implicated. Hence, the case. 3.On the ground that only on the basis of the confessional statement of the third accused this petitioner is implicated in this case. The learned counsel for the petitioner would submit that except this case, no similar case is pending. 4.The learned Additional Public Prosecutor would submit that five previous cases are pending are against the petitioner. Among which, one is under Section 302 of IPC and another one is for the offence of robbery. 5.Considering the bad antecedents of the petitioner this court is not inclined to grant anticipatory bail to the petitioner.
