O R D E R

This Writ Petition has been filed seeking for quashment of the impugned order passed by the second respondent vide proceedings in C.No:11/E7PS/Ndisc/2023 dated 09.08.2023 and directing the respondents to permit the petitioner to conduct Adal Padal Dance Programme scheduled to be held on 15.08.2023 in Arulmigu Sree Periyakkandi Amman Temple situated at Mangalam Village, Musiri Taluk, Trichy District.

2. With the consent of both the parties, this Writ Petition is taken up for final disposal.

3. The petitioner is the Trustee of Arulmigu Sree Periyakkandi Amman Temple. According to the petitioner, they are conducting the festival after 30 years and they have planned to conduct Adal Padal Dance Programme on 15.08.2023 between 07.00 p.m and 10.00p.m. The petitioner further submits that in earlier occasion also, no untoward incident took place.

4. The learned Additional Public Prosecutor appearing for the official respondents, on instructions, submits that there was no untoward incident took place earlier.

5. Considering the submission and also the fact that the temple festival is proposed to be held after 30 years, this Court is inclined to set aside the impugned order passed by the second respondent in C.No: 11/E7PS/Ndisc/2023 dated 09.08.2023 by issuing the following directions:- (i) The respondents Police are directed to grant permission to conduct Adal Padal Dance Programme on 3/6

15.08.2023 and other functions as stated in the representation given by the petitioner;

(ii) The petitioner is also directed to file an undertaking affidavit that they will conduct the programme without any problem.

6. With these directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
