O R D E R
[Order of the Court was made by S.S.SUNDAR, J.] The Suo Motu Contempt proceedings is initiated against the respondent for having committed criminal contempt by putting up
construction repeatedly in the public street after removal of the same by the Block Development Officer in compliance of the earlier order passed by this Court dated 10.12.2021.
2. Today, when the matter is taken up for hearing, the respondent appeared before this Court in person and filed an affidavit expressing unconditional apology for his act. In paragraph No.5 of the affidavit, it is states as follows:- "5.
I submit that I am aged about 82 years and sitting in the departure lounge of heavens Airport. Even a single day incarceration would adversely affect my health. Moreover, I have realized the mistake/violation and I sought for unconditional apology from bottom of my heart. I would not commit such kind of violation in future. The photographs annexed in the typed set of papers would evidencing the fact that I have removed the encroachment made on the public street."
3. Considering the age of the respondent, his submission that he will not commit any such violation in future and the fact that he has removed the encroachment made on the public street, this Court accepts the unconditional apology expressed by the respondent. However, considering the act of the respondent in putting up construction repeatedly in the public street after removal of the same, the respondent Contemnor is warned that if he indulge in such action in future, he will be punished severely.
