For Respondent : Mr.S.S.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.283 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324, 448 of IPC r/w Section 4 of Tamil Nadu Prohibition of Women Harassment Act, in Crime No.283 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that due to the previous enmity the accused person entered into the house of the defacto complainant, abused her and her mother in filthy language and caused assault upon them using wooden plank. Hence, the case. 3.The earlier application was dismissed on the ground that the petitioner has filed a petition before Principal District Judge, Trichy, seeking anticipatory bail. Now it is brought to the notice of this Court that the petitioner is involved in Crime No.157 of 2018, which is also assault case under Section 326 IPC. It is also reported that the above said matter is pending. After obtaining the bail in the above said case, the petitioner involved in the present case.

4.Considering the habitual nature of the petitioner, this Court is of the view that the petitioner is not entitled for anticipatory https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.16777 of 2022 bail. The petitioner shall surrender before the regular Court and seek regular bail.

5.With the above directions, this criminal original petition is dismissed.
