PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the second Respondent to hand over the entire investigation of the case in Crime No.90/2022 dt.10/6/2022 to any other independent investigation agency under supervision of first Respondent and direct them to file final report within the period of stipulated by this Court.

O R D E R

This Criminal Original Petition has been filed to direct the second Respondent to hand over the entire investigation of the case in Crime No. 90/2022 dt.10/6/2022 to any other independent investigation agency under supervision of first Respondent and direct them to file final report within the period of stipulated by this Court.

2. The learned Counsel for the Petitioner submits that the Petitioner is an Exservice man and aged about 67 years He had purchased a two wheeler bearing Reg. No. TN 79 5837- Suzuki Access 125 while Colour in the year 2014. On 09.06.2022 around 9.00 pm., he parked his two wheeler in front of his house and in the next day he found it missing. He had lodged complaint based on which First Information Report in Crime No.90 of 2022 dated 10.06.2022, came to be registered Subsequently Petitioner received a message on 19.06.2022 on his mobile that his vehicle was found parked in the Tirunelveli Railway Station and directed him to pay fine. It is the further submission of the learned Counsel for the Petitioner that the Petitioner on his own enquiry he came to know that his own son-in-law had stolen it. The 2/5

Investigation Officer has not proceeded with the investigation. Therefoe he has filed this present petition.

3.The learned Additional Public Prosecutor would submit that they had completed investigation and examined 13 witnesses. When the Investigation Officer had examined 13 witnesses, the Investigation Officer is directed to lay the final report before the Court concerned and produce the vehicle within the period of 15 days from the date of receipt of a copy of this order.
