ORDER

This Criminal Original Petition filed, under Section 528 of BNSS., seeking orders, to withdraw and transfer the investigation in Crime No.131 1/4

of 2024 on the file of the second respondent to any other investigation agency.

2. When the matter is taken up for hearing today, learned Government Advocate (Criminal Side) appearing for the State would submit that on the basis of the complaint given by the petitioner, FIR came to be registered in Crime No.131 of 2024 on 09.05.2024 for the alleged offence under Sections 294(b), 147, 149, 447, 426, 435, 436 and 506(2) IPC. He would further submit that they have examined five witnesses sofar and the investigation is pending.

3. The learned counsel for the petitioner would submit that though the complaint was lodged in 2023, they have not taken any action and hence, the petitioner was constrained to file a petition under Section 156(3) Cr.P.C., and in pursuance of the direction of the trial Court, FIR came to be registered.

4. Considering the submissions made by the learned counsel on either side, the second respondent is directed to proceed with the investigation and the jurisdictional Deputy Superintendent of Police is directed to monitor the 2/4

investigation and file a final report before the jurisdictional Court at an early date.

5. With the above directions, this Criminal Original Petition stands disposed of.
