Mr.R.Suresh Kumar Government Advocate (crl.side) PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.180 of 2023 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 380 of IPC in Crime No.180 of 2023, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 11.06.2023, the petitioner along with 1/3

other co-accused had stolen the cellphone belonging to the defacto complainant. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He has not committed any offences as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) for the respondent police submitted that on account of the bad antecedents, the earlier application was dismissed by this Court by order dated 11.07.2023. Now the accused Nos.1 and 2 were arrested and they were released on bail. The mobile phone has been recovered. The petitioner has involved in a similar case in Crime No.77 of 2022 also.

5. Considering the antecedents of the petitioner, the bail granted to the coaccused does not enure to the benefit of the petitioner. I find absolutely no change of circumstances.
