Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the District Munsif cum Judicial Magistrate Court, Singampunari, to dispose of C.C.No.190 of 2022 within the time frame stipulated by this Court.

ORDER

The petitioners, who are the accused Nos. 1 and 2 in C.C.No.190 of 2022, have filed this petition seeking a direction to the trial Court, namely, 1/6

the District Munsif cum Judicial Magistrate Court, Singampunari, to conclude the proceedings in C.C.No.190 of 2022 within a stipulated time.

The learned counsel appearing for the petitioners submits that a civil dispute has been projected as that of a criminal case and the respondent Police has filed the final report in a mechanical manner. The case in Crime No.124 of 2021 was registered in the year 2021 and the final report was filed in the year 2022. However, there is no progress in the trial.

According to the learned counsel, the 1st petitioner/1st accused is working in Singapore on contract basis and in view of this case, he could not return to Singapore and to comply with the contract. In the event, if the 1st petitioner/1st accused does not appear before the Company at Singapore, then, his livelihood would be affected. Since the trial is not progressing, the 1st petitioner/1st accused could not report for duty at Singapore. Hence, this petition has been filed seeking a direction to the trial Court to conclude the proceedings in C.C.No.190 of 2022.

4. The learned counsel appearing for the petitioners submits that in view of the difficulty faced by the 1st petitioner/1st accused, they went to the 2/6

extent of advising the petitioners to admit their offence and go abroad. In fact, the petitioners are having a good case and this case is a foisted one. Therefore, the petitioners seek for a direction to the trial Court to conclude the trial proceedings in C.C.No.190 of 2022 within a stipulated time.

5. The learned Government Advocate (Crl. Side) submits that the case is of the year 2022. The case is posted on 26.09.2025 for the examination of L.W.1 to L.W.5. According to the learned Government Advocate (Crl. side), the trial Court is concentrating only on the old year cases 2020-2021. According to him, summons have also been received for appearance of L.W.1 to L.W.5 and they would be produced before the trial Court on 26.09.2025.

6. This Court considered the rival submissions made.

7. The Judicial Officers are expected to take up the cases only on chronological basis. It appears that there are lot of cases even from the year 2020-21. While so, this Court cannot issue any direction to the trial Court to conclude the proceedings in C.C.No.190 of 2022, which is of the year 2022. At the same time, the trial Court has to pay some attention for other 3/6

cases, which are of the year 2022.

8. It is reported that the trial Court has issued summons for appearance of L.W.1 to L.W.5 and trial is posted on 26.09.2025. Therefore, this Criminal Original Petition is disposed of with the following directions: (i) The respondent Police is directed to produce the witnesses on the same day;

(ii) The trial Court, namely, the District Munsif cum Judicial Magistrate, Singampunari, is directed to examine all the witnesses without adjourning the case to some other date;

(iii) The petitioners/accused 1 and 2 have to cross examine the witnesses, when the chief examinations are taken; (iv) The trial Court shall find out the possibility of summoning the remaining witnesses and examine them as expeditiously as possible. 31.07.2025 NCC : Yes/No Index : Yes/No Internet:Yes ogy 4/6
