PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondents particularly the respondents 1 to 3 to harass the petitioner unnecessarily without any fault on him at the guise of enquiry For Petitioner : Mr.A.Devaki For Respondents : Mr.K.Suyambulinga Bharathi No.1 and 2 Government Advocate(Crl.Side)

ORDER

This petition has been filed seeking direction to direct the respondents particularly the respondents 1 to 3 to harass the petitioner unnecessarily without any fault on him at the guise of enquiry

2. It is seen that the petitioner is a tenant. The landlord in the said proceedings is facing SARFAESI proceedings initiated by the third respondent herein. Without due process of law now the first and second respondent are trying to evict the petitioner on the influence of the third respondent. The learned counsel for the petitioner would further submit that the respondents 1 to 3 also obtained acceptance letter from the petitioner illegally as if he https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.14398 of 2019 will vacate the premised situated at No.130, TPS Nagar, First Main Road, Thanjavur within a period of two weeks.

3. Considering the above facts and circumstances of the case the respondents 1 to 3 are directed to not to harass the petitioner without any complaint or petition enquiry against the petitioner. It is made clear that the petitioner is a tenant under the fourth respondent and as such the respondents 1 to 3 can very well approach the appropriate Court for appropriate relief in the manner known to law to evict the petitioner.

4. With the above direction, the Criminal Original Petition is disposed of.
