PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the 2nd Respondent to provide Police Protection to life and limb of the Petitioners and their family members from the Respondents 3 and 4 and their men.
For Petitioners :Mr.R.Murugappan For R1 and R2 :Mr.B.Thanga Aravindh Government Advocate (crl.side) O RDER This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking for a direction to the respondent police to provide protection from the unofficial respondent Nos.3 and 4. 2.It is submitted by the learned counsel that the petitioner No.1 has borrowed vehicle loan from the respondent No.3, for which the petitioner No.2 stood as Guarantor. The petitioner No.1 has committed default in payment of money, on which the matter was placed before the Arbitrator and the Arbitrator is proceeding with the case. During the pendency of the said case, the respondent Nos.3 and 4 stated to have sent their people to the residence of the petitioners and threatened them with dire consequences and also stated that in case if the entire 2/5
amount is not settled, they will obstruct the petitioners and therefore sought for protection basing on the complaint filed by them on 05.08.2023. 3.The learned Government Advocate (Crl.side) submits that the representation given by the petitioners has been received by the police and they are going to complete the investigation shortly by issuing notice on both side. 4.Considering the submissions made by the learned counsel on either side and on perusal of the records, this Petition is disposed of directing the respondent police to complete the investigation as quickly as possible, not later than two weeks from the date of receipt of a copy of this order. It is needless to state that the petitioners have been specifically mentioned that even though the proceedings have been taken place before the Arbitrator and the respondent Nos.3 and 4 have sent their persons unauthorizedly, the police are directed to take stern action against them.
