ORDER

This Civil Revision Petition has been filed seeking a direction to the learned Sub Judge, Srivilliputtur, to expedite the enquiry in A.S.No.43 of 2016 and to dispose of the same within a time to be fixed by this Court.

2. The learned counsel appearing for the revision petitioner submits that the revision petitioner filed an appeal in A.S.No.43 of 2016 as against the Judgment and Decree dated 08.12.2014 passed in O.S.No.567 of 2007 on the file of the Additional District Munsif Court, Srivilliputtur. Though the said appeal has been filed in the year 2016, the same is pending for the past three years without any progress. Hence, the learned counsel seeks direction for early disposal of A.S.No.43 of 2016. The learned counsel further submits that as per the Judicial Notification No.C-5 CAS/2007 Tamil Nadu Case Flow Management in Subordinate Courts/Rules 2007, Appeal Suit should be disposed of within a period of 24 months. But, as per the said Notification, the same has not been disposed of till date.

Considering the facts and circumstances of this case and also in view of Judicial Notification No.C-5 CAS/2007 Tamil Nadu Case Flow Management in Subordinate Courts/Rules 2007, the learned Sub Judge, Srivilliputtur, is directed to dispose of A.S.No.43 of 2016, on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. With the above direction, the Civil Revision Petition is disposed of. No costs.
