Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the third respondent to consider the representation of the Petitioner's counsel dated 25.02.2014 and also direct the third respondent not to register any document executed by the fifth respondent or any other person, relating to Survey No. 296/4A1A, Narikudi Village, Kadaladi Taluk, Ramanathapuram District. ORDER

None appears for the writ petitioner.

2. The prayer is for directing the third respondent to consider the objection lodged by the petitioner through his counsel and for restraining the contesting private respondents from dealing with the petition mentioned land.

3. The first part of the prayer cannot be granted. The Sub Registrar is exercising statutory functions. The writ Court cannot restrain the statutory authority from discharging his statutory functions. The petitioner has private dispute with the fifth respondent herein. The petitioner has to necessarily move 2/4

the jurisdictional civil Court for resolving his disputes. The process cannot be short-circuited by invoking writ jurisdiction.

4. Leaving open all the rights and remedies of the petitioner, this writ petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
