Respondents Prayer :- Criminal Original Petition filed under section 482 of Cr.P.C., praying to call for the records in CC NO. 112 of 2016 on the file of the Learned Judicial Magistrate, Cheranmahadevi, Tirunelveli District and quash the same .

ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and earlier order of this court and upon perusing the letter submitted by the Additional District Munsif Ambasamudram / District Munsif cum Judicial Magistrate, Cheranmahadevi (FAC) vide its letter in D.No.637 Dated 19/04/2021, praying for further time to dispose of the case in CC.No.112/2016 pending on its file, this Court made the following order:

While disposing of Crl.O.P.(MD)No.20468 of 2016, this Court has given a direction to the trial Court to conclude the case on merits and in accordance with law within a period of six months from the date of receipt of a copy of that order. The order was passed on 15.10.2020.

2. Now the learned District Munsif Cum Judicial Magistrate, Cheranmahadevi, has addressed a letter dated 17.04.2021 stating that P.W.1 to P.W.9 were examined and the case is posted on 22.04.2021 for further witness of L.W.10. Due to lock down, the Court was not able to dispose of the case in time. He seeks further time for disposal of the case.

Considering the reasons stated by the learned District Munsif Cum Judicial Magistrate, Cheranmahadevi, and finding the genuineness of the reasons stated, three (3) months further time is granted for disposal of the case on merits and in accordance with law, from the date of receipt of a copy of this order.
