PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent's order 280/DCE/Land loser dated 10.08.2018 and quash the same and direct the respondents to provide a job to the petitioner as per his qualification in the 3rd respondent institution. ORDER
This Writ Petition has been filed challenging the order passed by the third respondent dated 10.08.2018 and to direct the respondents to provide a job to the petitioner as per his qualification in the third respondent institution.

The petitioner herein claiming himself to be the son of the land owner, whose lands were acquired by the Government of India for the purpose of defence installation of Indian Navy at Vijayanarayanam, Tirunelveli. According to the petitioner, the persons who are losing the land under the Land Acquisition Act are entitled to get employment from the beneficiary of the land. He further submitted that he is a qualified person to be employed and he has also sent
various representations for this purpose, whereas, he has not been given any employment. In this regard, he has also sent a representation dated 01.02.2018 to the President of India and the same was forwarded to the third respondent, who passed the impugned order refusing to accommodate the petitioner with employment. Hence, he has come forward with this Writ Petition seeking to quash the above order and consequently, for appointment to the suitable post.
3. The learned counsel for the petitioner submits that the petitioner has obtained a certificate from the competent authority to show that he is a land loser and he has also sent various representations and his case has not been properly considered and he has not been given employment thereafter.

Per contra, the learned counsel appearing for the respondents 2 to 4 submits that already the land owner, namely, Murugaiah, who is the father of the petitioner herein, had approached the Central Administrative Tribunal for the very same relief in O.A.No.1055 of 1996 and it was dismissed by the Tribunal on the ground that there was no promise made for granting appointment to the petitioner's father. Thereafter, that order was challenged by way of Writ Petition in W.P.No.10668 of 2000 and the same has also been dismissed.
5. That being the case, the petitioner cannot claim employment on the same ground. It is also submitted by the respondents that already the petitioner was informed that he has no right to claim employment on the ground of land loser and the issue has already reached its finality. Once again, considering the very same relief as claimed by the petitioner does not arise.
6. Accordingly, the Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 28.08.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No Lm To 1.The District Collector, Tirunelveli, Tirunelveli District.
