Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order of the 3rd respondent in Ref.No.1622/104/Madurai/2013, dated 09.12.2013 in so far as not extending the benefits of continuity of service and pay protection in terms of section 47(1) of Persons with Disability (Equal Opportunity, Protection of Rights and Full Participation) Act, 1995, quash the same and consequently directing the respondents (i) to regularize the period of 721 days from May 1999 to July, 2001 as duty with pay protection and all other attendant benefits and (ii) further directing the respondents to treat the period from 21.08.2013 to 10.12.2013 as duty with continuity of service, pay protection and also with back wages payable to the petitioner from 21.08.2013 to 10.12.2013 within the time limit that may be fixed by this Court.

ORDER
The learned counsel appearing on behalf of the writ petitioner made a submission that the writ petitioner was a retired Conductor and died during the pendency of the writ petition. The learned counsel for the writ petitioner further states that inspite of several communications, he could not able to get instructions from the legal heirs of the deceased writ petitioner for the purpose of proceed with the case. However, if the legal heirs are interested in pursuing the matter, they are at liberty to do so within a reasonable period of time. Thus, the writ petition stands closed. No costs.
