ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the first respondent.

2. The petitioner is a member of Mukkudal Hindu Nadar Mahamai Sangam. He alleges that the second respondent had committed irregularities. He wants action to be taken under provisions of the Tamil Nadu Societies Registration Act, 1975. Since representation dated 17.02.2014 given by him before the first respondent did not elicit any response, the present writ petition came to be filed.

3. After hearing the learned counsel on either side, I am satisfied that a case for issuance of direction has not been made out. The Sangam is a registered Society. The petitioner must mobilize the requisite strength in the general body and thereafter petition the first respondent. In such event, the first respondent would be statutorily obliged to take action under Section 36 of the Act. It is of course open to the first respondent also to take suo motu action at the instance of a solitary member. In democracy numbers determine the outcome. The numbers are not on the side of the petitioner. 2/4

4. This writ petition stands dismissed. There shall be no order as to costs.
