ORDER
This Writ Petition has been filed seeking a Mandamus to direct the third respondent to allow the petitioner, a minor, to continue his studies in Class XII for the academic year 2025-2026.
2. The learned counsel for the third respondent submits that the petitioner has been mischievous and has disrupted regular classes, thereby, vitiating the classroom atmosphere. As a result, he was asked not to attend classes. The learned
counsel further submits that the writ petition is liable to be dismissed, particularly, since the petitioner has not submitted any representation to the school and has directly approached this Court seeking a Writ of Mandamus.
3. I have considered the submissions made by the learned counsel for the petitioner and the learned counsel for the third respondent.
4. The third respondent cannot express an inability to discipline a student, as schools are not only meant for academic education but also for instilling values in their students.
5. Considering the above, I am inclined to dispose of this Writ Petition, by directing the third respondent to permit the petitioner, Minor Manoj Kumar, to attend classes for the academic year 2025-2026, subject to the petitioner and his parents filing a detailed affidavit undertaking that the minor will not indulge in any further misconduct and will abide by the disciplinary rules of the school. The petitioner may also be permitted to attend supplementary and additional classes to make up for the 30 days of lost academic time. The third respondent is also directed to consider waiving the petitioner's absence during the said period.
6. The Writ Petition stands disposed of accordingly. No costs. Consequently, connected Miscellaneous Petition is closed. NCC : Yes / No 19.08.2025 Index : Yes / No smn2 Note:- Issue order copy on 20.08.2025.
