Mr.D.Ghandiraj, learned Special Government Pleader takes notice for the respondents.
2.The writ petition has been filed for a Mandamus to direct the fourth respondent to implement the direction issued by the third respondent in O.Mu.A3/2850/2025 dated 22.05.2025 for preparing a report in the manner known to law and to direct the third respondent to complete the exercise of cancellation of legal heir certificate of the petitioner's deceased son, M.Govindaraj in Certificate No.TN720250208651 dated 15.02.2025. 2/6
3.The petitioner is the mother of late.M.Govindraj, who died on 25.12.2024. According to the petitioner, her son, M.Govindraj, was married to one G.Prema.
4.It is submitted that the marriage between the petitioner's son, M.Govindraj and the said G.Prema was dissolved by the 1st Additional Subordinate Court, Tiruchirappalli, in HMOP.No.201 of 2012, vide judgment and decree, dated 10.10.2014.
5.The learned counsel for the petitioner submits that the said judgment and decree, dated 10.10.2014, has not been reversed so far and that the petitioner's son's former wife, G.Prema, has however obtained a legal heirship certificate as if she was the wife of the deceased Govindraj on 15.02.2025. 6.It is submitted that unaware of the above, the petitioner has applied for separate legal heirship certificate, which was granted on 05.05.2025 by incorporating the name of the petitioner and the son of late.Govindraj and his 3/6
divorced wife, G.Prema. Therefore, the petitioner had sent a representation for cancellation of the aforesaid legal heirship certificate, dated 15.02.2025. 7.It is submitted that the third respondent/the Revenue Divisional Officer, Musiri, has already directed the fourth respondent to act on the petitioner's application. However, the fourth respondent has not yet taken any steps. 8.The petitioner has made out a case for cancellation of the legal heirship certificate, dated 15.02.2025, which was procured by the petitioner's daughter-inlaw, since divorce. 9.Considering the same, there shall be a direction to the fourth respondent to complete the exercise for cancellation of the aforesaid legal heirship certificate, dated 15.02.2025, after issuing notice to the said G.Prema within a period of six weeks from the date of receipt of a copy of this order. 4/6
10.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
