ORDER

This Criminal Original Petition has been filed, invoking Section 528 B.N.N.S., seeking orders, to direct the second respondent police to comply the order passed by the learned Judicial Magistrate, Tirumangalam in Crl.M.P.No.2383 of 2024, dated 04.03.2024 to register the case in SCR.No.93 of 2024 based on the complaint given by the petitioner, dated 21.08.2023 within the time stipulated by this Court.

When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that in pursuance of the directions given by the learned Judicial Magistrate summons were issued to the concerned parties including the petitioner; that the accused 1 and 2 have not appeared and that taking note of the dismissal of the suit filed by the petitioner and two others, and pendency of the appeal, they were not in a position to take any action on the complaint given by the petitioner and on that basis, they have submitted a report before the jurisdictional Magistrate Court.
