ORDER
This Criminal Original Petition has been filed to direct the second respondent to withdraw the lookout circular vide Originator Reference No.05221/FRB/MD/2023, dated 01.07.2023 in connection with Crime No.301 of 2023, dated 12.05.2023 on the file of the third respondent.
2. Now the grievance of the petitioner is that now investigation is pending. Pending investigation, lookout notice was issued to the petitioner. According to him, he has complied the conditions imposed upon him in bail application and the above said condition is relaxed by this Court.
3. The learned counsel for the fourth respondent would submit that if the petitioner is permitted to go abroad, he will never return back to India and face matrimonial proceedings that is pending before the concerned trial Court and the criminal proceedings also. 2/5
4. The learned Government Advocate (Crl.Side) would submit that so far as this case is concerned, investigation is completed and Final Report is filed on 27.07.2023 through E-Filing No.1063 of 2023 before the learned Judicial Magistrate, Melur.
5. There shall be direction to the learned Judicial Magistrate, Melur, to process the above said Final Report within the time stipulated as per rules. The petitioner is at liberty to approach the concerned trial Court seeking permission to go abroad. The above said permission may be granted to the petitioner considering the facts and circumstances. Let the above said petition be disposed of within a week from the date of filing of that petition.
6. The learned counsel for the fourth respondent is very particular about the address details of the petitioner in Canada.
7. Considering the submissions made by the learned fourth respondent, address details of the petitioner in Canada shall be given to the respondents. So that, the further process can be undertaken very 3/5
easily.
8. With the above said directions and liberty, this petition is disposed of.
