Respondent / Complainant Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honble Court in Crl.OP.(MD).No.8967 of 2023 dt.18.5.2023 and modify the condition to direct the Petitioner appear before some other Police Station at Coimbatore on 10.30 a.m. every Sunday, instead of appearing before the Inspector of Police, Cyber Crime (CCD III) Police Station, Pudukottai District every sunday at 10.30 a.m., until further orders.. Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.JINNAH S.M.A., Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate (Crl. side) on behalf of the Respondent, the court made the following order:- 1/3
This petition has been filed to modify the condition imposed upon this petitioner by this Court in Crl.O.P(MD).No.8967 of 2023 dated 18.05.2023.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent police. 3.The learned counsel for the petitioner submitted that the co-accused filed modification petition before this Court. This Court had fully relaxed the condition imposed upon the co-accused.
4. The learned Government Advocate(Crl. Side) appearing for the respondent police submitted that the co-accused's wife is pregnant, on that ground, this Court has considered the co-accused's modification petition and fully relaxed the condition imposed upon him.
5. In view of the above, this Court is not inclined to extend that benefit to this petitioner. Accordingly, this Criminal Miscellaneous petition is dismissed and the petitioner is directed to appear before the respondent police on every Saturday at 10.30 a.m., until further orders.
