PRAYER :- For Bail in Crime No.19 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners / accused, who were arrested and remanded to judicial custody on 25.08.2022 for the offences punishable under Section 6 r/w. 5(i), 5(ii) of Protection of Children from Sexual Offences Act, 2012 @ 294(b), 506(i) IPC, 6 r/w. 5(1), 5(j)(ii) of Protection of Children from Sexual Offences Act, in Crime No.19 of 2022 on the file of the respondent police, seek bail. https://www.mhc.tn.gov.in/judis
2.The case of the prosecution is that A1 subjected to sexual intercourse with the defacto complainant and threatened her with dire consequences. Subsequently, she became pregnant. Hence, the complaint.
3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they are no way connected with the offence and their names have been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioners herein are relatives of A1 and the specific overtact against the petitioners is they accompanied with A1 to do the offence. He would further submit that the investigation is still pending and strongly objected to grant bail to the petitioners.
5.Considering the manner in which the offence took place and that it is serious nature of offence, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed.
