PRAYER :- For Anticipatory Bail in Crime No.163 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 147, 148, 294(b), 323, 324, 307 and 506(ii) I.P.C, in Crime No.163 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that on 03.06.2023 at about 2.30 p.m., the 1/3

petitioner along with other accused unlawfully assembled, abused the defacto complainant in filthy language, also assaulted him and threatened him with dire consequences. Hence, the complaint.

3. Heard both side and perused the materials available on record including the First Information Report. The earlier anticipatory application is dismissed as withdrawn on 17.07.2023. After that, this petition has been filed, stating that the petitioner is aged about 61 years and some of the co-accused were enlarged on bail.

4. The learned Additional Public Prosecutor would submit that the petitioner is involved in Crime No.117 of 2023.

5. Reading of the First Information Report shows that the victim was kidnapped by the accused persons, taken to the remote place, wherein, he was assaulted. Over simple issue of repayment of loan amount, the above said kidnap and assault said to have taken place. Apart from that considering the bad antecedent of this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
