PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 6 to lay a thar road through the cart track of Survey Nos.149 & 152 of Pichampatti Villgae, S.Kallupatti Revenue Village, Kariapatti Taluk, Virudhunagar District to enable the village people to reach the main road.

ORDER

The relief sought for in the present Writ Petition is to direct the respondents 1 to 6 to lay a thar road through the cart track of Survey Nos.149 & 152 of Pichampatti Villgae, S.Kallupatti Revenue Village, Kariapatti Taluk, Virudhunagar District to enable the village people to reach the main road. 2/5

2.The project requires financial sanctioning from the competent authorities. Therefore, High Court cannot issue any positive direction to lay thar road through cart track. Whether it is a necessity or not is to be assessed based on various factors prevailing in that locality. Thus, the petitioner has to approach the 6th respondent for submitting necessary proposal if required to the competent authority for financial sanctioning and to lay thar road in the cart track. 3.With the above observations, this Writ Petition is disposed of. No costs.
