------------ The Hon'ble High Court, while hearing the CRL OP(MD)no.18033 of 2021 it has been ordered as follows:

When the matter was taken up for hearing, the learned counsel for the petitioner sought permission of this Court, to withdraw this petition. However, objections were raised by the learned Additional Public Prosecutor that simultaneously the petitioner filed a bail petition before the District Court, Kanyakumari, yesterday (03.01.2022).

2. Whether the pendency of the bail petition before this Court, is disclosed on the bail application or not, is not clear on records. Therefore, a report is called for from the learned Principal District Judge, Kanyakumari, along with a copy of the bail petition filed by the petitioner herein.

3. Since serious allegations have been made, simultaneously two petitions have been filed before two Courts, now the petitioner is seeking permission to withdraw this petition seeking bail. action, a report be called for from the learned Principal District Judge, Kanyakumari along with a copy of the petition filed therein and the records.

4.List the matter on, 21.01.2022.
