PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to issue loan discharge receipt to Loan No.939 availed the loan from the 3rd respondent/Padamanapuram, Co-operative Housing Board Society Y-339, Saroad, Pandkasalai, Moolakkal, Mekkamandapam, Kannyakumari District and consequently direct the respondents to return back the original documents to the loan for the said for security, within the stipulated time as may be fixed by this Court. Mr.D.Ghandiraj, learned Special Government Pleader takes notice for the respondents.
2.The writ petition has been filed for a Mandamus to direct the respondents to issue a loan discharge receipt to Loan No.939 availed from the third respondent and to direct the respondents to return back the original documents. 3.The petitioner has given a representation to the respondents on 17.04.2025 in respect of the loan secured by the petitioner's father and for 2/5
issuance of a discharge certificate. According to the petitioner, the petitioner has discharged the loan as early as on 19.12.2023. 4.The learned Special Government Pleader for the respondents, on instructions, submits that a sum of Rs.85,500/- is still due as of 31.07.2025. 5.Considering the rival position taken, there shall be a direction to the respondents to consider the petitioner's representation, dated 17.04.2025, as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. The petitioner may examine as to whether the amount of Rs.85,500/- is still to be paid. In case, it is so, the petitioner shall pay the same for obtaining no due certificate from the respondents. 6.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
